By participating in the TORK test ride experience (the “Activity”), I acknowledge and agree to the following:
2、ASSUMPTION OF RISK
I understand that operating or riding an electric dirt bike involves inherent risks, including but not limited to loss of control, collisions, falls, equipment malfunction, bodily injury, property damage, serious injury, and death.I fully understand and voluntarily assume all risks associated with participation in the Activity, whether known or unknown.
3、PARTICIPANT RESPONSIBILITY
I agree to:
- Follow all instructions provided by TORK staff
- Wear all required safety equipment
- Operate the vehicle in a safe and responsible manner
- Immediately stop riding if instructed by TORK staff
I further confirm that:
- I am physically capable of participating safely in the Activity
- I am not under the influence of alcohol, drugs, or any medication that may impair my ability to operate the vehicle safely
4、RELEASE OF LIABILITY
To the fullest extent permitted by law, I release, waive, discharge, and hold harmless TORK, its affiliates, officers, directors, employees, agents, contractors, representatives, Electrify Expo, event organizers, sponsors, venue owners, and partners (collectively, the “Released Parties”) from any and all claims, liabilities, damages, losses, costs, or expenses arising out of or relating to my participation in the Activity.This release includes claims arising from ordinary negligence of the Released Parties, but does not apply to claims arising from gross negligence, reckless conduct, or willful misconduct.
5、VEHICLE DAMAGE
I understand that reckless, unsafe, negligent, or intentionally abusive operation of the vehicle may result in immediate removal from the Activity.If damage to the vehicle results directly from such conduct, I may be responsible for the reasonable cost of repair or replacement, not to exceed the actual cost of parts and labor.
6、MEDIA RELEASE
I understand that photographs and video recordings may be taken during the Activity.By participating, I grant TORK and its affiliates the right to photograph, film, record, reproduce, publish, distribute, and use my image, likeness, voice, and appearance for advertising, marketing, social media, website content, promotional materials, and other commercial purposes without compensation or additional approval.If I do not wish to be photographed or recorded, I will notify TORK staff before participating.
7、PRIVACY
I understand that information submitted during registration may be used by TORK for event administration, customer communications, product updates, and marketing purposes.TORK will not sell my personal information to third parties for unrelated marketing purposes.I may opt out of marketing communications at any time.
8、MEDICAL AUTHORIZATION

This Waiver shall be governed by the laws of the State of California.Any dispute arising from this Waiver or participation in the Activity shall be resolved exclusively in the courts located in Los Angeles County, California.

12、ELECTRONIC CONSENT
By selecting “I agree” during registration, I acknowledge that I have read and understand this Waiver, voluntarily agree to its terms, and intend my electronic acceptance to be legally binding.
